How to Check a Builder's HCRA Licence in Ontario
Since 2021 every builder and vendor of new homes in Ontario has to be licensed by the Home Construction Regulatory Authority, and the record is public. Here is how to read it, and what it does not tell you.
Who needs the licence
The HCRA licenses people who build new homes for sale or build them under contract for an owner, and people who sell new homes. Renovators, trades, and homeowners building their own house do not need it. Tarion is a separate organization that runs the warranty; a builder has to be HCRA-licensed to enrol a home with Tarion, and most of what the directory shows comes from both. The two-minute check
- Open the Ontario Builder Directory.
- Search by the business name on the quote or the contract. Also search the owner’s personal name, because some operators move between company names.
- Confirm the licence status is active and the licence class matches what they are doing for you (building under contract on your lot, or building to sell).
- Read the numbers: homes built, homes enrolled with Tarion, years licensed. A builder claiming 30 years with three enrolled homes has some explaining to do.
- Read the conditions and the discipline history: licence conditions, charges, convictions, Tarion claims and chargeable conciliations. A clean record is normal; a record with warranty claims paid by Tarion because the builder did not fix the work is the thing you are looking for.
- Check the registered address and the principals against the people you have been dealing with.
What the record cannot tell you
Whether the builder is any good. A licence means they met the competency, financial and conduct requirements to hold one; it does not mean their framer is careful or their schedule is honest. For that you need the proof pack: references from homes finished three or more years ago, a site visit, insurance and WSIB clearance, and a contract you have read. When the name is not there
Three possibilities. They are a renovator or a trade and do not need the licence: fine, for a renovation. They are building under a different corporate name: ask, and search that one. Or they are building new homes without a licence, which is an offence under the New Home Construction Licensing Act, means the home cannot be enrolled with Tarion, and tells you what you need to know about how they handle rules in general. You can report an unlicensed builder to the HCRA; more usefully, you can walk away.
Owner-builders and the licence
If you are building your own house with your own trades, you do not need an HCRA licence and the home will not have Tarion coverage. If you plan to sell the house soon after it is built, the HCRA and Tarion may treat you as a vendor, which does need a licence and enrolment.
